Although fiscalization rules in Québec are not new for certain taxpayers, recently authorities have decided to start a transition from sales recording modules (SRMs) to a new cloud solution, the WEB-SRM.
Since November 1, 2023, the restaurant sector has been undergoing an IT shift to replace the sales recording module (SRM) with a cloud solution (the WEB-SRM). This is the same IT solution already in use in the remunerated passenger transportation sector since 2021.
WEB-SRM is a cloud-computing environment that validates and stores transaction data before securely sending it to Revenu Québec.
The transition to the WEB-SRM and the corresponding phase-out of the physical SRM is considered by the authorities as beneficial for operators. The new cloud solution will reduce their administrative overhead and save them time by eliminating the need to send periodic sales summaries every month. They will also be able to view transaction data sent using a certified sales recording system (SRS) in My Account for businesses. In addition, their customers will now be able to scan a QR code on their receipt to view a summary of it online.
A financial compensation program is being prepared for operators who purchased and activated one or more new SRMs after October 31, 2021, but before November 1, 2023. An SRM recycling program will also be available.
The main obligations of most operators of establishments or businesses covered by the measures include having the required equipment, sending prescribed information to Revenu Québec, providing receipts to customers within the prescribed timeframe, creating user reports and keeping records and supporting documents.
This new system implies obligatory usage of a certified sales recording system (SRS). That is a device that includes an authorized version of software certified by Revenu Québec to manage and record sales, produce bills, credit notes and other documents, and send information to Revenu Québec.
However, authorities accent that certification of a product is not a guarantee of its performance. The developer is solely responsible for keeping its product compatible with the WEB-SRM. Use of the product and any omissions or mistakes when sending information to the WEB-SRM is the operator’s responsibility and that of the developer.
If mandatory billing obligations and related rules are not met, defined penalties and fines can be imposed which can be as high as $25 000, and in some cases, a fine combined with a maximum of six months in prison can be imposed.
